Should a department determine they wish MSM to sponsor an employee for permanent residency, they will need to proceed with the following steps:

Step 1: The supervising faculty must write a departmental support letter stating that the non-immigrant occupies or has been offered a permanent, full-time faculty position (Series I or II), non-faculty academic position at the Research Associate level or higher, or non-academic professional position requiring an advanced degree and pass it on to the Chair of the Department/Center/Institute for signature. “Permanent,” as defined by regulations (8 CFR 204.5 (i)(2)), means “either tenured, tenure-track, or for a term of indefinite or unlimited duration, and in which the employee will ordinarily have an expectation of continued employment unless there is good cause for termination.”

Step 2: After receipt of this letter, OIPS will meet with the prospective permanent resident applicant (and supervisor if desired) to determine the best route in sponsoring them for permanent residency (see Eligibility).

Step 3. The prospective permanent resident, in conjunction with OIPS and the sponsoring department, will gather the documentation and evidence required in filing a Form I-140 petition to sponsor the employee for permanent residency, which may include processing a Labor Certification Application for approval by the U.S. Department of Labor prior to filing Form I-140.
